According to the 54-FZ, all companies and sole proprietors must use an online sales register and issue receipts or accountable forms when making payments to customers. The exception is certain types of business: sales of newspapers and magazines, ice-cream shops, market trading, shoe repairing, key making, and others. Some companies located in remote regions may operate without an online sales register as well.
The equipment must be recorded at the Tax Service and be included in the list of sales registers. The tax authorities require sole proprietors to submit data on settlements at the time of payment. To do this, you need to connect a fiscal storage drive and draw up a contract with a fiscal data operator (OFD). Failure to comply with these requirements and operation without a sales register threatens a business with administrative liability and substantial fines:
- for sole proprietors: 25-50% of total amount of settlements made without recording, but not less than 10,000 rubles;
- for LLCs: from 75% up to total amount of money earned without a sales register, but not less than 30,000 rubles.
For a repeated violation, when total amount of settlements made without fiscalization reached 1,000,000 rubles or more, the following sanctions are imposed:
- disqualification of the director for 1-2 years;
- administrative suspension of the company's operations for up to 90 days.
If a company or sole proprietor doesn't provide required information and supporting documents, or violates the terms, the Tax Service will also impose the following fines: for a sole proprietor: 1,500 — 3,000 rubles, for a company: 5,000 — 10,000 rubles.
If you don't provide a customer with a paper or electronic receipt, or an accountable form, and they report this to the Federal Tax Service, you'll be fined. In this case, fines will amount to 2,000 rubles for sole proprietors and 10,000 rubles for LLCs.
